Medical Cannabis-based CBD products

This word has gone viral as it is being searched, followed, tagged by almost every individual after the approval of a Marijuana-based pharmaceutical drug, Epidiolex, by the US-FDA officials.

However, the legalities behind the usage of CBD are still unclear as patients can use CBD products after getting a medical marijuana card in Los Angeles. Thus, it is still not clear which source of CBD is legal and which is not.

To make it crystal clear, recently California banned Hemp-based CBD products. The California Public Health Department issued a letter stating that Hemp-based CBD oil is banned in the state.

According to the state officials, they have made clear that Manufactured Cannabis Safety Branch (MCSB) has the authority to regulate cannabis products for medicinal and recreational use.

However, these do not include any hemp-based food products. Rather, these food products are regulated by the Food and Drug Branch of the California Public Health Department (CDPH-FDB).

This development has struck the hemp industry as well as patients who were dependent on such products in a big way.

What do Californian Officials have to say?

It is really surprising that California has shown much enthusiasm regarding cannabis legalization. However, it is not inclined to legalize CBD products from Hemp until FDA gives its official approval that it is safe for human and animal consumption.

Thus, CBD products as food additives or supplements will be held illegal.

What exactly is the difference between Hemp and Cannabis- based CBD Oil?

Only aspect that makes Hemp and Cannabis different is the presence of THC content.

While Hemp contains only 0.3% THC or less in dry weight basis, cannabis contains THC levels more than hemp.

Why is California making it illegal when other states have no issue?

According to the federal Farm Bill 2014, more than 30 states have issued guidelines and allowed the production of Hemp. This includes California too.

However, California Department of Food and Agriculture (CDFA) is refusing to be persuaded until the FDA issues an official statement that the use of industrial hemp-based CBD products is approved as a food or food additive/supplement.

Till then, there is a little hope that this restriction would be called off any time soon.

I am certain only few will be familiar that as per the guidelines stated in 21 U.S.C. §350d, the Registration of Food Facilities, you must verify that the FDA registration of the manufacturer of the hemp-based CBD products in food before buying them.

However, still there are many manufacturers in the market who are selling fake products online. Hence, in my opinion, these regulations are meant to stop such illegal activities in the state.
